Apple and FAS will meet in court

Investing.com — The Moscow Arbitration Court on January 18 will consider the claim of Apple (NASDAQ: AAPL) against the Federal Antimonopoly Service (FAS), according to data on the court's website.

The department previously ordered Apple to change the rules for admitting applications in the App Store.

In response, the iPhone manufacturer demanded that the actions of the FAS be declared illegal, which, following the antimonopoly regulators of both Europe and America, is trying to change the company's policy towards application developers..

On August 10, the FAS admitted that Apple was abusing its dominant position in the app distribution market by investigating the complaint. «Kaspersky Labs», indicating that the company «limited competition in the market for the distribution of tools and opportunities for developing parental control applications».

«Apple holds a dominant position with a 100% share of the distribution market for mobile applications on the iOS operating system, since it is possible to install such an application legally only from the App Store», — stated in the FAS decision.

Since October 2018, the apple company has consistently implemented a policy of restricting tools and opportunities for developing parental control applications, «as a result of which most of the functionality of third-party applications was lost».

The FAS noted that these actions coincided with the release of Apple's own pre-installed application «Screen time» (Screen Time), which has functionality similar to that of parental control applications.

In addition, the company reserves the right to exclude any third-party application from the App Store, even if it meets all Apple requirements..

The FAS concluded that the company violated part 1 of Article 10 of the Law on the Protection of Competition and demanded, by November 30, to eliminate violations of the antimonopoly legislation and provide competitive conditions for developers of mobile applications.

«Until now, the FAS Russia has not received information from Apple on the execution of the order», — told the TASS agency to the department, recalling that the company has five more working days to report on its performance.
